The Problems of Military Involvement in Handling Simultaneous Demonstrations in August 2025

Demonstrations are one of the mechanisms for voicing opinions in the public sphere. This research examines the implications of military involvement in handling civil demonstrations that occurred in several cities in August 2025, as well as examining the emergency regulations in Indonesia based on Law No. 23 of 1959. This study aims to provide conceptual and juridical clarity regarding the limits of Presidential authority in addressing crisis situations that do not yet meet the criteria for a state of emergency but require a response involving defense institutions. The research method used in this paper is normative legal research with library research. The research findings indicate that the President has the authority to declare emergency status in conditions of serious threats to national security. However, military involvement in handling public demonstrations is considered disproportionate because constitutionally the military functions as a state defense instrument, while domestic security falls under the domain of the National Police. Therefore, strict oversight mechanisms are necessary to prevent abuse of power and the militarization of law enforcement in a democratic state.
