Reconfiguring Islamic Family Law in Indonesia: Between Communicative Deliberation and Domination from a Collaborative Governance Perspective

This study analyzes the reconfiguration of Islamic family law in Indonesia from a collaborative governance perspective by examining the relationships among the state, religious organizations, Islamic scholars (ulema), and the public in the formation and implementation of Islamic family law. Departing from previous studies that generally examine Islamic family law through either normative-juridical or socio-legal lenses in isolation, this research offers novelty by integrating Jürgen Habermas’s theory of communicative action and Mark Granovetter’s social network theory as an analytical framework to explain the linkage between formal deliberative processes and the influence of social networks in shaping Islamic family law. Employing a qualitative approach with a library research method, this study reviews statutory regulations, academic literature, and relevant research findings. The findings indicate that the implementation of collaborative governance in Indonesian Islamic family law has not fully reflected the principles of inclusive deliberation. The dominance of formal institutions, such as the Ministry of Religious Affairs and the Religious Courts, remains more prominent than the substantive involvement of religious organizations, local ulema, and the public in policy-making processes. Conversely, social networks rooted in religious authority continue to exert a powerful influence on family law practices, including marriage, family dispute resolution, and public acceptance of state regulations. These findings demonstrate that the effectiveness of collaborative governance is determined not only by inter-institutional collaboration among formal bodies but also by the capacity to integrate socio-religious networks into the law-making process. Consequently, this study provides a conceptual contribution to the development of a more participatory, deliberative, and contextual model of collaborative governance within Islamic family law in Indonesia.
