Post-Publication Discussion

Istinbath: Jurnal Hukum welcomes constructive scholarly discussion, commentary, and academic feedback concerning articles after publication. Post-publication discussion is an important part of scholarly communication because it allows readers, researchers, practitioners, authors, and other members of the academic community to raise questions, provide critical comments, clarify findings, challenge interpretations, or discuss legal and methodological issues related to published articles.

The journal is committed to maintaining the accuracy, transparency, integrity, and reliability of the scholarly record and will facilitate post-publication discussion in accordance with applicable publication ethics and editorial policies.

Post-Publication Comments

Readers who wish to comment on, question, or discuss a published article may contact the Editorial Office through the journal's official email address or other designated communication channels.

Submitted comments should:

  • be directly relevant to the published article;
  • provide a clear and substantive scholarly contribution;
  • be based on evidence, legal reasoning, scholarly literature, or other appropriate academic sources;
  • clearly identify the issue, argument, interpretation, methodology, legal authority, or finding being discussed;
  • maintain a respectful, professional, and academically appropriate tone; and
  • avoid personal attacks, defamatory statements, discriminatory language, unsupported allegations, or inappropriate content.

Comments relating to legal interpretation, judicial decisions, legislation, Islamic law, socio-legal issues, or other matters within the scope of Istinbath: Jurnal Hukum should be supported by appropriate legal authorities, scholarly references, or relevant empirical evidence.

The Editorial Team will evaluate submitted comments for academic relevance, clarity, evidence, ethical considerations, and compliance with the journal's publication policies before determining whether they are suitable for publication, editorial consideration, or further scholarly discussion.

Author Response

When appropriate, the authors of the original article may be invited to respond to substantive comments, questions, or concerns raised after publication.

Authors are encouraged to provide responses that are:

  • clear and focused on the issues raised;
  • supported by relevant evidence, legal authorities, or scholarly sources;
  • respectful and academically constructive; and
  • transparent regarding any errors, limitations, or matters requiring clarification.

Where appropriate, Istinbath: Jurnal Hukum may publish the original comment together with the author's response as part of the scholarly record.

The journal may also facilitate further academic discussion when the matter contributes significantly to the development of legal scholarship or clarification of an important legal issue.

Corrections, Clarifications, and Concerns

If post-publication discussion identifies a potential error, omission, factual inaccuracy, incorrect legal citation, methodological problem, ethical concern, undisclosed conflict of interest, or other issue that may affect the reliability or integrity of a published article, the Editorial Team will assess the matter carefully.

Depending on the nature and significance of the issue, Istinbath: Jurnal Hukum may take appropriate editorial action, including:

  • publishing a clarification;
  • issuing a Correction;
  • publishing an Expression of Concern;
  • initiating an investigation;
  • updating relevant publication information; or
  • issuing a Retraction when the integrity of the article is substantially compromised.

Minor errors that do not materially affect the findings, arguments, interpretation, or conclusions of the article may be addressed through an appropriate correction or clarification notice.

Relationship with Research Misconduct Procedures

Post-publication discussion does not replace the journal's formal procedures for handling allegations of research misconduct.

If comments or discussions raise concerns relating to:

  • plagiarism;
  • data fabrication or falsification;
  • duplicate or redundant publication;
  • citation manipulation;
  • authorship disputes;
  • undisclosed conflicts of interest;
  • research ethics violations; or
  • other forms of publication misconduct,

the matter will be handled according to the relevant publication ethics and research misconduct policies of Istinbath: Jurnal Hukum.

Editorial Moderation

Istinbath: Jurnal Hukum reserves the right to moderate, decline, edit for clarity, or remove comments that:

  • are irrelevant to the published article;
  • lack substantive academic content;
  • contain personal attacks or abusive language;
  • contain defamatory or discriminatory statements;
  • make unsupported allegations against authors, reviewers, editors, or institutions;
  • contain promotional, commercial, or spam content;
  • disclose confidential or private information without appropriate authorization; or
  • otherwise violate the journal's publication ethics and scholarly communication standards.

Editorial moderation will not be used to suppress legitimate scholarly criticism, disagreement, or debate.

Transparency and Scholarly Record

Where a post-publication discussion results in a formal editorial action, Istinbath: Jurnal Hukum will seek to maintain transparency by ensuring that relevant notices are clearly linked to the original article whenever technically possible.

Corrections, Expressions of Concern, Retractions, and other post-publication notices should clearly identify:

  • the article concerned;
  • the nature of the issue;
  • the editorial action taken; and
  • the date of the action.

The journal will seek to preserve the integrity of the scholarly record rather than remove published content without appropriate justification.

Appeals and Further Communication

Authors or readers who disagree with an editorial decision arising from post-publication discussion may submit a reasoned request for reconsideration to the Editorial Office.

Requests should provide clear academic, legal, methodological, or ethical grounds for reconsideration. The journal may seek additional editorial review or independent expert advice where necessary.

The final decision will be made by the Editor-in-Chief or an editor who has no conflict of interest in the matter.
