Justice for PLHIV Workers: Islamic and National Legal Approaches to Protecting Labor Rights

Discrimination against people living with HIV/AIDS (PLHIV) is an important issue that requires significant attention in the context of social Justice. This study aims to examine legal protections for the labor rights of PLWHA through Islamic and national legal approaches, as well as to assess the extent to which principles of Justice and non-discrimination have been implemented in labor practices. Additionally, this study identifies the forms of discrimination experienced by HIV-positive individuals in the Workplace and analyzes coercive regulations aimed at protecting their rights. This research is a normative legal analysis, employing a legal approach, case studies, and Islamic legal principles that emphasize Justice and non-discrimination. The research findings indicate that although national laws provide some protection, their implementation remains weak, with loopholes that allow discrimination, resulting in PLHIV often facing stigma and unfair treatment. This study recommends strengthening regulations and socialization to raise awareness of the rights of people with HIV, as well as the need to integrate Islamic legal values into employment practices to create an inclusive and fair work environment.
