Abstrak

The problem solving of economic syariah disputes through the litigation way that composed in UU. No. 3 in 2006 about The Religious Court in  subsection 49 and strengthen by the decision of Mahkamah Konstitusi No. 93/PUU-X/2012 that explain about the optional right in UU No. 21 in 2008 that not have the absolute rule, so the logic implementation is every economic syariah disputes (in litigation way) should be finished in Religious Court. Meanwhile, the Syariah economy participants in Metro City, tend to choose the problem solving through non-litigation way.  This article try to do the polarization  how that controversy to solve by the Syariah economy participants in Metro City. This research do in 5 BMT/LKS (Islamic Micro-Finance Institutions) through observation and interview. Overall BMT/LKS do in non-litigation way to solve the controversy the achievement of the member with consideration economic factors, simplicity, and keep the good relationship with the member. The solution are do reprimand, reconstruction of debt, sales collateral, and debt relief. Each of BMT/LKS that the subject of the research do this steps with the different intensity.
